Terms and Conditions for Course Purchasers

The ownership and provision of all programs, products, courses, and services are the responsibility of Dinara Photos("Company," "we," "us," or "our"). When we refer to "you" or "your," we are addressing any user or purchaser of the mentioned program(s), product(s), course(s), or service(s) (collectively referred to as the "Course"). These Terms and Conditions of Use ("Terms") govern and establish the guidelines for your use and access of the Company's Course. We reserve the right to modify and update these Terms as needed, with the "date last updated" indicated at the top of this page.
It is important to note that you are legally bound by these Terms, whether or not you have read them. If you do not agree with any of the Terms, please contact us at info@dinaraphotos.com, and we will make reasonable efforts to remove your name, email, and access to our Course and website(s).
1.Your Consent and Usage of the Course
Upon purchasing a Course from us, you were provided with reasonable notice regarding the existence of these Terms. By proceeding with your purchase and accessing the Course, you agreed and continue to agree to comply with these Terms, including any disclaimers and privacy disclosures contained within. You confirm that you are at least 18 years old or of legal age in your applicable jurisdiction to access the Course. The access of our Course(s) and related materials by a minor is a violation of use, and we reserve the right to terminate your access if such an issue is discovered.
2.License(s)
Limited License. Subject to and in accordance with these Terms and any additional guidelines or instructions provided within the Course, we grant you a limited, non-transferable, non-sublicensable, non-exclusive, and revocable license ("License") to use the Course for your individual purposes, including any courses you have purchased. Your purchase of a Course entitles you solely to view that specific Course under the aforementioned License. It does not constitute a purchase of the software or content comprising the Course. Specifically, unless explicitly authorized in these Terms or by the owner of the materials, you are prohibited from modifying, copying, reproducing, republishing, uploading, posting, transmitting, translating, selling, creating derivative works, exploiting, or distributing any Course material in any manner or medium (including electronic means such as email) without permission. However, you may occasionally download and/or print one copy of individual Course pages for your personal use, provided you retain all copyright and other proprietary notices.
The License is intended for individual use only. You may not assign or transfer any of your rights or obligations under this section or these Terms to any person or entity, and any such attempt is considered void. We reserve the right to terminate your access to the Course at any time if we determine that you have violated these Terms. We will strive to notify you of any such violation and provide an opportunity to rectify it. However, if you fail to remedy the violation or persist in violating the Terms, we reserve the right to terminate your access to the Course without refunding any fees.
3.Refunds
All sales of the photography course are final and non-refundable. Once the payment is made, no refund or exchange will be provided for any reason. By purchasing the course, you acknowledge and agree that you will not be entitled to a refund, even if you do not complete or access the course content.
4.Termination
You have the sole right to terminate your use and access to any of our Course(s). To initiate the termination process, please send an email to info@dinaraphotos.com . However, please be aware that termination does not absolve you of any outstanding payment obligations. Upon confirmation of your termination, any unpaid balances will immediately become due and payable. If there is any remaining balance that remains unpaid after 14 days from the date of termination, it will be forwarded to a collections agency. You agree to be responsible for any additional charges, fees, or costs associated with the collection efforts, which may include reasonable attorney's fees and court costs.
5.Intellectual Property
All images, text, designs, graphics, page layout, icons, videos, logos, taglines, trademarks, and service marks are the property of Dinara Photos or the respective attributed party. Using any of our intellectual property, in whole or in part, is a violation of federal law. Modifying any materials provided in the Course is illegal and may result in legal action, including seeking financial penalties (damages) and/or an injunction to cease the use of our intellectual property immediately.
You are permitted to:
- Access the Course for your personal use.
- Download and/or print Course materials for your individual business use (if additional team members need to download and/or print materials, each team member must purchase a separate Course).
- Use our trademarks and copyrighted materials with our prior written consent, giving proper credit and marking them appropriately.
You are not permitted to:
- Resell or trade your access to the Course.
- Share the Course with individuals who have not purchased it or opted to receive it.
- Reprint any part of the Course, except as mentioned above for your personal use.
- Republish any part or the entirety of the Course.
- Distribute any materials from the Course or related materials and communications as your own.
- Reproduce and modify any part or the entirety of the Course for distribution as your own work.
- Claim ownership or use of any of our intellectual property without our prior written consent, including copyrights (e.g., course materials, worksheets, workbooks, lessons, videos, etc.), trademarks (e.g., names, logos, taglines), or trade dress (including the Course's overall look and feel, related communications, and materials).
- Use the Course or related materials and communications unlawfully or for any illegal or unlawful purposes.
6.Civil and Criminal Penalties
Although our Courses are intangible and not physical property, copying, stealing, infringing, or otherwise violating these Terms can result in charges of theft or other civil and criminal penalties. We reserve the right to prosecute infringers to the fullest extent permitted by criminal or civil statute in any jurisdiction. By opting into or purchasing any Course or accessing its related communications and materials, you explicitly consent to personal jurisdiction in California.
7.Your Materials and Contributions
When you submit a comment, photo, video, or other material on any website or platform owned or maintained by us, you agree that we have a non-revocable, commercial license to republish your submission, in whole or in part, unless you explicitly state otherwise. By accessing our Course(s) or related materials, you have no right to privacy, and we reserve the right to disclose your participation.
8.Model Release
You must own the copyright to any images you use in our Course or related materials. By default, you grant us a commercial license to any images you voluntarily provide, such as a Facebook profile photo or other profile image, when accessing the Course or upon our request. This default or voluntary release of your image and likeness may be used for reasonable future business purposes.
9.Notification of Use
We are not obligated to notify you or anyone else of our use of photographs or other images you submit to us by default or voluntarily in our own publications.
10.Confidentiality
Unless explicitly stated in a subsequent client agreement or mandated by law or fiduciary duty, you have no right to confidentiality.
11.Assumption of Risk
By accessing our Course(s) and/or related materials, whether paid or unpaid, you assume all the risk associated with your access and any subsequent actions you choose to take based on the influence, information, or educational materials provided to you.
12.Disclaimers
General Disclaimer
To the maximum extent permitted by law, we explicitly exclude any liability for any direct, indirect, or consequential loss or damage incurred by you or others in connection with our Course(s). This includes, but is not limited to, accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental illness, conditions or issues, physical, mental, emotional, or spiritual injury or harm, loss of income or revenue, loss of business, loss of contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted time, and any other kind of loss or damage, regardless of negligence, breach of contract, or any other cause, even if such loss or damage was foreseeable. We are not medical, legal, financial, or other professionals. If we are professionals, we are not offering our professional services during the term of this Course, and you explicitly agree that we are not acting in any professional capacity, including medical, legal, financial, or otherwise. You agree to protect and defend our Company, along with our affiliates, agents, contractors, officers, directors, shareholders, employees, joint venture partners, successors, transferees, assignees, and licensees, from any claims, damages, liabilities, costs, and expenses, including legal fees and expenses, related to our Course(s).
Limitation of Liability. Dinara Photos, its affiliates, officers, employees, agents, partners, and licensors will not be held responsible for any direct, indirect, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, data, or other intangible losses, resulting from or connected to your use of our Course(s). We are not liable for any actions or outcomes caused by third parties, accidents, delays, harm, or any negative consequences resulting from accessing our Course(s) and related material(s). In no event shall the total liability of the course provider exceed the amount paid by you for the course.
Dispute Resolution. You agree to notify the Company of any concerns or issues regarding the Course, allowing us an opportunity to resolve them. If we are unable to reach a resolution through good-faith negotiation, you agree to attempt alternative dispute resolution or mediation before initiating a civil lawsuit. If a civil lawsuit is filed relating to the Course(s), the laws of California will apply.
Non-Disparagement. If you engage in slander, libel, or any other form of disparagement against our Company, Course(s), or related materials, you will be promptly removed from the Course(s) and associated communications. We reserve the right to take legal action against you for any such damaging actions that harm our Company.

All Rights Reserved. The Company reserves all rights that are not explicitly granted in these Terms and Conditions of Use or expressly written here.
16.Payment and Access
The payment for the photography course must be made in full at the time of purchase to gain access to the course materials.
Upon successful payment, you will receive login credentials to access the photography course content through the designated online platform.
17.Amendments
The course provider reserves the right to amend or update these Terms and Conditions at any time without prior notice. Any changes to the Terms and Conditions will be effective immediately upon posting on the course website, and your continued use of the course content constitutes your acceptance of the revised Terms and Conditions.
By purchasing the photography course, you agree to abide by these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, you should refrain from purchasing the course.
